PhaseX (“we”, “us”, or “our”) is a U.S.-based online community designed to support private traders in the stock and cryptocurrency markets. Our community operates primarily through a members-only Discord server for subscribers, and we use our official website for member registration and payment processing. This Data Protection Policy (“Policy”) explains how we collect, use, disclose, and protect your personal information when you interact with PhaseX services. By subscribing to or participating in the PhaseX community (via our website or Discord), you agree to the practices described in this Policy. We are committed to safeguarding your privacy in accordance with applicable United States laws and regulations (including the California Consumer Privacy Act, CCPA).
For purposes of this Policy, “personal information” (also known as personal data or personally identifiable information) means any information that identifies, relates to, or can reasonably be linked to an individual or household . We strive to be transparent about our data practices and protect your information as described below.
Personal Information We Collect
We collect personal information from you when you register for PhaseX, subscribe to our services, or otherwise directly provide it. The types of information we may collect include:

(Please note that chats or content you share on the PhaseX Discord server are also subject to Discord’s own privacy policy, as Discord is a third-party platform.)

This can include your IP address, device type, browser type, operating system, referring URLs, and browsing actions on our site (such as pages viewed and the dates/times of access). This data helps us administer and secure the website and may be considered personal information under U.S. law (for example, IP addresses can be linked to individuals).
We collect personal information directly from you (e.g. information you enter during sign-up or payment), and automatically through your use of our website (see Cookies and Tracking Technologies below). We do not obtain personal data from third-party sources for PhaseX, except as needed to verify payments or prevent fraud (for instance, we may receive payment confirmation from our payment processor). We will not collect any more personal information than is necessary for the purposes outlined in this Policy. If you choose not to provide certain information (such as required contact or payment details), you may be unable to access some PhaseX services (for example, we cannot set up a subscription without payment information).
How We Use Your Information
We use the personal information we collect for purposes consistent with the reasons you provided it to us, as well as to support our legitimate business needs. Specifically, PhaseX may use your information in the following ways:
Providing and Improving Our Services: To create and manage your member account, authenticate your access to the private Discord community, and deliver the services and content you have subscribed to. This includes processing your subscription payments, granting you the appropriate access permissions, and providing trading-related content or updates. We also analyze user behavior and feedback to improve our services and the functionality of our website/Discord offering. For example, we may review usage patterns or conduct research on how members use our community features in order to enhance the user experience.
Communication: To communicate with you about your account and PhaseX services. We will send administrative emails or messages (for instance, account confirmations, payment receipts, technical notices, updates about changes to our terms or this Policy, or security alerts) . We may also respond to your inquiries or support requests, and send newsletters or announcements about community events and market updates if you have subscribed to such communications. You can opt out of non-essential communications (like marketing emails) at any time by following the unsubscribe instructions provided in those messages or by contacting us.
Security and Fraud Prevention: To protect the integrity of our community and services. For example, we may use personal information to verify your identity (ensuring that accounts are not fraudulent), to monitor for fraudulent transactions or unauthorized access, and to enforce our community rules and Terms of Service. Information such as device data and IP addresses may be used to detect and prevent suspicious or malicious activity and to maintain the security of our website/Discord.
Compliance with Legal Obligations: To comply with applicable laws, regulations, and legal processes. We may process your data as necessary to fulfill tax and accounting requirements (e.g., maintaining payment records for financial regulations), or to respond to lawful requests by public authorities (such as court orders, subpoenas, or government inquiries).
Other Legitimate Business Interests: We may use personal data for other legitimate interests, such as improving our service offerings, debugging and troubleshooting technical issues, performing data analysis (in aggregate) to understand trends in usage, or, if ever applicable, to send you promotional materials about new features or services (if consistent with your communications preferences and allowed by law). Legal Basis for Data Processing (U.S. Law)
PhaseX collects and processes personal information in accordance with United States law. Unlike some jurisdictions (such as the EU’s GDPR) that require a specific “legal basis” for data processing, U.S. privacy law – including the California Consumer Privacy Act (CCPA) – generally permits collection of personal data as long as businesses provide proper notice and rights to consumers . We want to assure you that our data practices rely on appropriate grounds even if not explicitly required by U.S. law:
Consent: In many cases, you provide your information voluntarily and consent to our use of it by signing up for PhaseX. For example, by entering your personal details and payment information to subscribe, you consent to us using that data to provide the service. If we ever ask for sensitive information or optional data, we will do so with your consent, and you may withdraw that consent at any time (for instance, you can unsubscribe from a newsletter you previously opted into).
Performance of a Contract: Much of our data processing is done to fulfill our obligations to you as a subscriber. When you purchase a PhaseX membership, a contract is formed (the Terms of Service), and we must process your personal information to deliver what we promised – e.g. granting you access to the Discord community and providing the subscribed content or support. This contractual necessity is a key legal basis for our use of your data.
Legitimate Interests: We may also process your information for purposes that support legitimate interests of our business or third parties, balanced against your privacy rights. Examples include using data to improve our platform’s functionality, preventing fraud/abuse, securing our system, or communicating important updates to members. We only rely on this basis for uses that you might reasonably expect as part of using our services.
Legal Obligation: When applicable, we will process or retain personal information as needed to comply with legal duties, such as keeping transaction records for financial regulations or responding to official legal requests. In such cases, the law itself is the basis for processing.
PhaseX is committed to handling personal data in line with the spirit of U.S. data protection principles and relevant laws. For example, the CCPA grants California residents specific rights over their personal information , and we have structured our Policy to uphold those rights for our users (see Your Privacy Rights below). While U.S. law does not require us to obtain explicit consent for every data processing activity (except in special cases like selling minors’ data or offering financial incentives ), we will always endeavor to collect and use information in a fair, transparent manner. If any data processing would require consent or a separate legal justification under applicable law, we will ensure to meet those requirements.
Cookies and Tracking Technologies

Data Sharing and Disclosure
PhaseX respects your privacy and does not share or disclose your personal information to third parties except in the limited circumstances described here. We do not sell your personal data for profit to data brokers or marketers at this time (see “Sale of Data” below for more details on that). When we do share information, we ensure it is for legitimate purposes and that appropriate safeguards are in place. The situations in which we may disclose personal information include:
Service Providers: We may share your information with trusted third-party service providers and vendors who perform services on our behalf. These providers include, for example, our payment processing company (to handle credit card transactions securely), web hosting providers, email distribution services (for sending newsletters or support emails), analytics tools, or customer support platforms. Such third parties are contractually obligated to use your information only to provide services to PhaseX and not for their own purposes. They must also protect your data and keep it confidential. For instance, our payment processor will receive your credit card details to process your subscription, but they cannot use those details for anything outside the payment transaction. We do not allowour service providers to sell or misuse your personal information .
Community Platform (Discord): PhaseX utilizes Discord as the platform for our private community discussions. We do not send your personal contact or payment information to Discord; however, by joining the PhaseX Discord server, your Discord username and any content you post will be governed by Discord’s own privacy policy and terms. We may maintain a record of your Discord user ID or username and your membership status in order to grant or manage your access to the community. Other Discord users may see your username and any information you choose to share in chats. Note: PhaseX admins moderate the Discord space, but we are not responsible for Discord’s handling of data. We recommend you review Discord’s privacy settings if you have concerns.
Legal Compliance and Protection: We may disclose personal information if we believe in good faith that such action is necessary to: (a) comply with the law or legal process (for example, responding to a subpoena, court order, or government request); (b) enforce our Terms of Service or other agreements; (c) investigate or assist in preventing illegal activity or violations of our community rules; or (d) protect the rights, property, or safety of PhaseX, our users, or others. This could include sharing information with law enforcement or regulatory authorities when mandated. We will attempt to notify you of such disclosures when permitted by law and feasible.
Business Transfers: If PhaseX undergoes a business transaction such as a merger, acquisition by another company, reorganization, or sale of all or part of its assets, your personal information may be transferred to the successor or acquiring entity as part of that transaction. We would ensure that any such entity is bound by confidentiality obligations and this Policy (or a policy with comparable protections) with respect to your personal data. Similarly, if PhaseX ever ceases operations or enters bankruptcy, information we have collected may be considered an asset and could be transferred to third parties in accordance with applicable laws. In any transfer of this nature, we will notify users (for example, via email or a notice on our site) if your personal information becomes subject to a new privacy policy.
With Your Consent: In cases where you have explicitly requested or agreed to a disclosure, we will share your information accordingly. For instance, if you ask us to feature a testimonial with your name on our website, or you use an integration that requires us to send data to a third party at your request, we will do so with your permission. Outside of such scenarios, we will not release your personal information to third parties for their own marketing or other purposes without obtaining your consent.
Aggregated or De-Identified Data: We may share information that has been aggregated or anonymized (so that it can no longer be linked to you personally) with partners, researchers, or the public. For example, we might publish user statistics like “80% of PhaseX members are interested in crypto markets” or share general website traffic trends. Such aggregated data contains no personal identifiers and is used to improve our services or illustrate usage patterns. This type of information is not considered personal and may be disclosed freely, as it cannot be traced back to any individual user.
Sale of Data: PhaseX does not currently sell personal information to third parties, and we have not sold any user’s personal data in the past 12 months . “Selling” in this context means sharing your personal information with third parties for monetary or other valuable consideration, as defined by laws like the CCPA. We take your privacy seriously and have chosen not to monetize your data in this way. However, we want to be transparent about the possibility of data sale in the future. If our practices change and we ever decide to sell personal information, we will update this Policy in advanceand provide you with clear notice and an opportunity to opt out of such sale . In fact, California residents have the right to direct businesses to stop selling their personal info (see Your Privacy Rights below), and we would honor and provide that right to all our users. Furthermore, we would not sell the personal data of any user known to be under 16 without the legally required opt-in consent (and under 13, without verified parental consent) .
Aside from the scenarios above, we will not disclose your personal information to any third party. In particular, we do not share or rent your personal details to advertisers or unrelated companies for their independent use. Minors’ Privacy (Children and Teens)
PhaseX is not intended for individuals under the age of 18. We do not knowingly collect or solicit personal information from anyone under 18 years old . Our services – including the Discord community and our website – are designed for adults (and mature teens) interested in trading; if you are under 18, you must not use PhaseX or provide any information about yourself to us. This is both for legal compliance and to ensure the safety and appropriateness of our community.
In alignment with U.S. child privacy laws, we take special care regarding minors’ data. The Children’s Online Privacy Protection Act (COPPA) prohibits collecting personal information online from children under 13 without parental consent . PhaseX does not direct any content to children under 13, and we will not knowingly collect information from children under 13 years of age. If we discover that we have inadvertently collected personal data from a user under 13 (for example, if a child managed to subscribe by using a parent’s information without our knowledge), we will delete that information as soon as possible.
For users between 13 and 17 years old: While our platform is not intended for minors under 18, a determined teenager could attempt to join. If you are under 18 but above 13, you should only use PhaseX with the involvement and consent of a parent or guardian. However, our policy is to discourage and generally not allow minors under 18. We do not offer different services or special accommodations for minors. If we become aware that we have collected personal information from a person under 18 without proper authorization, we will take steps to promptly delete the data and may suspend or terminate the account.
We also explicitly request that minors (under 18) do not submit any personal information to us. This includes not only contact and payment data, but also any content on Discord or elsewhere that might contain personal details. If you are a parent or guardian and you believe your child under 18 has provided personal information to PhaseX, please contact us immediately so we can investigate and remove the information if necessary. We reserve the right to ask for proof of age if we suspect a user of being underage.
By using PhaseX, you affirm that you are at least 18 years old (or the age of majority in your jurisdiction). We will not knowingly use or share any minor’s information in any way that violates applicable laws. This includes not selling data of minors – in fact, the CCPA requires opt-in consent before selling personal data of consumers less than 16 years old , which we fully abide by. Our commitment is to maintain a safe environment and to protect young individuals from having their data mishandled.
Your Privacy Rights
We believe you should have control over your personal information. Therefore, we honor several rights and choices regarding the data we hold about you. Depending on applicable laws (such as the CCPA for California residents) and our own policies, you have the following rights:
Right to Access (Right to Know): You have the right to request details about the personal information we have collected about you . This includes the categories of personal information we hold, the purposes for which we use it, the categories of sources from which we obtained the information, and, if applicable, the categories of third parties with whom we have shared or disclosed it . You may also request a copy of the specific pieces of personal information we have about you. Right to Deletion: You have the right to request that we delete personal information that we have collected from you . Upon your verified request, we will erase your personal data from our records and direct any service providers to do the same, subject to certain exceptions. For example, if we are legally required to keep certain data (such as transaction records for financial reporting or evidence of consent), or if the data is needed to complete a transaction you requested, we may not be able to delete it . We will inform you of any such exceptions in our response. Aside from those, we will honor valid deletion requests and permanently remove your personal information from our systems (and confirm to you that we have done so).
Right to Correction: If you believe that any personal information we hold about you is inaccurate or incomplete, you have the right to request a correction (sometimes called the right to rectification). Under new California privacy rules effective in 2023, consumers can ask businesses to correct inaccurate personal data . PhaseX will gladly update or correct your information upon request. For instance, if your email address or phone number has changed, or if you find a typo in your name in our records, you can contact us to have it corrected. We may need to verify the accuracy of the new information you provide and we will make the correction or add a supplemental statement to our records as appropriate.
Right to Opt Out of Sale of Personal Information: If we were to engage in the “sale” of personal information (as defined by applicable law), you have the right to opt out of such sale . As noted earlier in Data Sharing, PhaseX does not currently sell user data. However, if that ever changes, we will provide a prominent “Do Not Sell My Personal Information” option and honor any request you make to opt out. This means we will stop selling or sharing your personal data with third parties for valuable consideration once you direct us to do so . You will also be able to opt back in later if you choose, but we will not assume that without clear consent. This right applies broadly to all users in our community; for California residents, it is a protected right under the CCPA.
Right to Non-Discrimination: We will never penalize you for exercising any of your privacy rights. In other words, PhaseX will not discriminate against you for making a data request or opting out of data sharing . We will continue to provide you with our services at the same level of quality and features as before. For example, unless allowed by law, we won’t deny you services, charge you a different price, or provide a lesser experience just because you exercised your rights. The CCPA explicitly prohibits businesses from retaliating or offering different services to users who exercise their privacy rights , and we fully uphold this principle.
Exercising Your Rights: You (or an authorized agent acting on your behalf) may exercise any of these rights by contacting us through the channels listed in Contact Information below. For access, deletion, or correction requests, we will need to verify your identity to ensure the security of your data. This verification might involve confirming your account details or asking you to respond to an email or phone contact. For example, if you request data deletion, we may ask you to verify ownership of the email associated with your PhaseX account and perhaps provide a piece of information that we have on file (to match records). We will only use the information you provide for verification purposes and to fulfill your request.
We aim to respond to valid requests within the timeframe required by law (generally 45 days for CCPA, with an extension if necessary). There is no fee for making a reasonable request. If for some reason we cannot fulfill your request (due to a legal exception or inability to verify your identity), we will explain the reason in our response.
If you are a California resident, you may designate an authorized agent to make a request on your behalf. The agent will need to provide proof of authorization (such as a signed permission from you), and we may still require you to verify your identity directly with us or confirm that the agent has permission.
In addition to the rights above, you always have the option to simply update your information by logging into your account (for instance, you can change your email or password in your profile settings if our site offers that feature) and to opt out of marketing emails by using the “unsubscribe” link in those emails. By accessing our website or community from a non-U.S. jurisdiction, you acknowledge that you are doing so on your own initiative and that your information will be handled as per this U.S.-oriented Policy.
Should you choose to use PhaseX while located outside the U.S., be aware that your personal information will be transferred to and processed in the United States (and possibly other countries where our servers or service providers are located). By using our services from outside the U.S., you consent to the transfer of your personal information to the United States and its processing there. We do not currently adhere to any cross-border data transfer frameworks (such as the EU-U.S. Data Privacy Framework or similar) because we do not intend to process non-U.S. user data. In the event a non-U.S. user’s data is in our system, we will treat it with the same security and respect as U.S. data. However, certain rights available under foreign laws (for example, GDPR rights to object or data portability) may not formally apply. We consider privacy seriously for all individuals and, on a case-by-case basis, we will try to honor reasonable requests from international users as well, even if not legally required.

We will endeavor to respond to all legitimate inquiries promptly, typically within a few business days.
